Which contract to choose: employment, mandate or specific work

Poland has three main contract types, and which one you sign determines a lot: how much you take home, whether you get paid leave and sick pay, and whether you accrue work record and pension. Let's break it down in plain terms.

Umowa o pracę — employment contract

Umowa o pracę (employment contract) is the most protected option. It gives you paid leave, sick pay, and dismissal protections. All ZUS contributions are mandatory, so net pay is a bit lower — but you get full social protection. The best choice for a permanent job.

Umowa zlecenia — mandate contract

Umowa zlecenia (contract of mandate) is more flexible, often hourly. Fewer guarantees: sickness insurance is voluntary, and there's no default paid leave. But it has upsides: for students under 26, there are no ZUS contributions at all, and the tax-deductible cost rate (KUP) is 20%, so net pay is higher. Good for temporary or seasonal work.

Umowa o dzieło — specific-work contract

Umowa o dzieło (contract for a specific work/result) — a contract for a specific outcome, not an ongoing process. No ZUS contributions, so it pays the most on paper — but there's no insurance, no work record, and no sick pay. Tax authorities scrutinize this closely: it can't legally be used for ordinary manual labor — doing so is a violation.

Tip: if you're offered an umowa o dzieło for an ordinary job — warehouse, production, construction — that's a red flag. That contract type is illegal there and strips you of protection.

How to choose

  • Permanent job, you need guarantees and work record → umowa o pracę.
  • Temporary work, you're a student under 26 → umowa zlecenia can give you more net pay.
  • A one-off project with a clear deliverable → umowa o dzieło (but not for daily manual labor).
